Friends after revisiting the post of Ashok Sir in the morning I have concluded certain things which I want to share with you. He clearly mentioned that the chances of Main WP 3611/2011 will not be heard in most probabilities . This in my opinion means that the main matter is not listed today was known to the legal team. I think that the efforts to put up the main matter too were underway till the last moment but as per my opinion it did not happen as the Computer system in High Courts being such that no manual changes are allowed .
What is of paramount importance today as per my opinion was that the Divisional Bench straight away disregarded EOW’s claim that the Apex Court has allowed them investigation and ordered the stay to continue till the next hearing This shows the inclination of the Divisional Bench
I am painfully aware of the delay of 15 days but the pointers are in the right direction so please have patience

Economic offences wing gets court go-ahead to probe SpeakAsia ‘scam’

MUMBAI: The Bombay high court on Wednesday allowed the economic offences wing(EOW) to continue with its probe into the alleged cheating case involving multi-level marketing firm, SpeakAsia. Some of the investors, known as panelists, had filed a petition in the HC saying it was a civil dispute and not a criminal case.

BUT WHAT IS THE FACT ?
“This court has not passed any order in the said criminal application and that they had only recorded the statement of the learned APP”.It is another matter that our dear friend Justice Mr. Mateen Hafeez in an attempt to scandalize the process of the Hon’ble Court through his report appearing on page 4 in Times of India dated 16th June, 2012; had mischievously misquoted the happenings of the Court of 13th June, 2012.

ACTION TAKEN BY AISPA
AISPA has preferred to file a Criminal Application for Suo Motu Contempt of Court against Mateen Hafeez and some more persons, who have assisted him in publishing the mischievous and absolutely false report on page 4 in Times of India dated 16th June, 2012.

A Criminal Application vide Number APPW/322/2012 was filed on 19th June, 2012. This was mentioned before the Hon’ble Court Today, circulation of this has been allowed and the matter is now listed for hearing on Monday the 25th June, 2012

CURRENT STATUS (25th June 2012)
The hearing has taken place in Hon. Mumbai High Court and the court felt it proper that this application be taken up along with the original Writ 3611/2011 and EOW’s Application on 3rd July 2012.

• Authorities should help in getting the money refunded to consumers that is the real        PUBLIC INTEREST.

• EOW should STOP HARASSING CONSUMERS. We are honest Indian Citizens our fight is for protecting the rights of our Panelists and Consumers.

• Allow the company (SAOL) to restart business in India and help in providing EMPLOYMENT TO A LARGE POPULATION of computer educated middle class and lower middle class youth.

• Immediately set up a regulatory mechanism to monitor and regulate DIRECT SALES INDUSTRY.

• REWORK THE PCMC (banning) Act, 1978. Direct Sales Professionals are consenting adults and should be kept out of the purview of 2(c) of the Act.

• REGULATE THE MEDIA and control it from spreading false or malicious campaign. Media is indulging in CONTEMPT of COURT of the highest degree by prejudicing the system and the Judiciary.

Today it was a great day for us...After a long long time now i can feel that there is a word called "JUSTICE" in judiciary because of some great judges like Justice Khanwilkar whose bench was done for today

Eow came for the hearing today and were questioned by Justice Khanwilkar that HOW AND WHERE DID THEY GOT THE PERMISSION FOR INVESTIGATION BY SC for which eow was unable to answer and were confused about it and said there was some miscommunication that has happened

Apart from this TIMES OF INDIA was also taken in loop for publishing false and baseless news about our company in their so called fake newspaper...EOW's request for investigation on our company was refused by the GOD OF JUSTICE...And now the matter has been listed for 3rd JUL for hearing...

An application is likely to get filed against TIMES OF INDIA for publishing False news in their fake newspaper which everyone must have read few days ago...

Regarding AP case the good thing that happened is that the bench will be changed which means that our hearing in AP will be heard soon without any more delays and we can expect some relief as and when heard by the new bench

So friends stay united and keep informing your downlines and team by any source about the happenings which is going on as now it seems that things are coming back on track with great justification looked upon on 3rd Jul now

Good Evening Speakasians !!!

Once again after a long time our best friend TOI have started with their false and baseless news to create rumour and panic amongst all our family members…Now it should be well known to all of us that as per the news reporter of TOI talks without any proof and create baseless stories on request of some people who does not want our things to happen fast and all they look is to break our unity by their false reporting…

Now i would like to tell all that things are very flexible and uncertain with us we need to see what outcome comes on hearing which is coming on Monday for AP HC and also the hearing for MHC which is said to be on 28th jun instead of 2nd jul now…We need to see how much relief we can get from these two hearings scheduled to happen…

Now another thing that i came across that some Anti-Speakasians are trying to spread some message through SMS which was sent to some panelist and the message was from TD-SPEAKASIA and was sent in Jharkhand and Punjab to some panelist…The message is not true and should be made aware to all speakasians to stay away from such kind of rumours which is spreaded through Email,sms and other sources to create panic amongst all ….STAY AWAY FROM IT

Friends i would like to inform all that please do not believe in baseless news and rumours spreaded by Media and other channels sources as we all are part of the company and we should be with it strong and positively…

Believe only on our company communication which shall arrive soon after some outcome is comes from HC or any step taken forward by the company which they will be pleased to inform…

Our company is giving its best efforts to restart the business based on outcome of court hearing and govt. authority so if any outcome happens only then some communication will come from the company for all our awareness…Rest please everyone take care of yourself and wait for some outcome from the Govt…

As I start to write this update few questions come to my mind, which are being asked by many panelists who call me from all over the country.

The questions listed below are not in any order of importance or priority:
1) Why has the company terminated some employees?
2) Why had the company asked us to keep ready the first set of documents thereby indicating that that restart was around the corner?

3) Why were we advised to keep our sights away from the Court Matters?

4) Why were we asked to “Tighten our Seatbelts” when nothing tangible was in the company’s hands?

I attempt to address the following questions as below:

 at the outset I once again wish to remind this entire family of Speakasians that AISPA is an association of the Panelists and consumers of the company SAOL.
Both these organizations are separate entities and have no operational dependency in any form on one another.
AISPA is an independent organization.
Why has the company terminated some employees?

We all need to understand that the company is in the “people’s” business.

The basic and the most important asset of the company is the “people” associated with the company as employees or as Panelists and consumers.

This act of the company has been a delayed action and should in fact have come at least six months earlier. If the company was in any sort of traditional business they would have done this at least six months back.
That they waited thus far is only because of the nature of our business, which is based on personal relations and dependent on “People”.



I also wish to draw your attention to the fact that it is common in the corporate world whenever a corporate goes in for organizational restructuring, people restructuring is an essential part of such a restructuring plan and this has happened in the SAOL case showing clearly that the company is looking ahead to coming back in a better, more organized and streamlined manner.

It is a dynamic world with various forces working around the clock changing the dynamics and basic matrix of a business model, added to this the challenge of ever changing technological platforms which force a corporate to restructure and align itself to the new dynamics of its business model.<br>
Case in point is when in April 2012, HSBC laid off approx 850 personnel followed by Standard Chartered and Tata AIG. All these companies were forced to look at a better structured man power spread; the need of the hour was to have a lean and mean organization in the new financial year. <br>
Singapore financial year started on 1^st June and the new plan has been implemented on the same very day.

All in all we should look at this step as a positive and sense that the company has started to get into ship shape.
Is it that the company is getting ready for the impending BUSINESS RESTART?



In any case this act should not affect us Panelists and Consumers even one bit as this falls entirely in the Company’s purview and we should not even venture there.

Why had the company asked us to keep ready the first set of documents thereby indicating that that restart was around the corner?

I wish to draw your collective attention to the last para of the company’s letter dated 26th April as under:

“Please do note that this only a preparatory exercise in anticipation of our business re-starts. Once we get all the permissions from the concerned authorities, we will communicate with you for the next set of actions to be taken”.

It is a normal phenomenon that an individual listens, processes and understands only what we wants to listen and understand.
This is the biggest challenge for communication gurus across the world, added to this is a herd like mentality prevalent in societies like India where everybody tends to believe and follow a particular view point which suits their sensibilities, even if it is far from what has been actually communicated.</p>

The company has over time understood that it takes a long time for any communication to percolate down to the last of the levels, more so now in the absence of “POP UP” Communications.

The company probably did not want any further delays once the Business restarts, as getting documents like Pan Card, ID proof etc are time consuming for people who don’t have it already, this communication came as a fore warning to galvanize people to start acting towards getting these documents in place.

We on the other hand immediately jumped to the conclusion and started rejoicing as if the company had announced RESTART.
The enemy was our misunderstanding of the communication, and the victim was the large, over anxious, Speakasian Family.

I crave leave and request to be allowed to answer the next two questions together:

Why were we advised to keep our sights away from the Court Matters?

Why were we asked to “Tighten our Seatbelts” when nothing tangible was in the company’s hands?

Before I attempt to clarify these two statements which basically emancipated from AISPA, allow me to explain the role of AISPA and the modalities of the updates on AISPA.

 We are still waiting for PE process if it has been completed or still under progress.Our company management is working and they are not at all communicating with anyone as things are kept highly confidential…Once our work is completed we can expect the communication from company to arrive soon…

Its a time of suspense and surprise… Due to no communication please do not follow or listen to any other news that you will hear in the coming days from anyone no matter whomsoever it is…We are waiting something to hear from the company which is very soon and we can expect something good to hear by them.

All Speakasians please do take care of yourselves for the time being till our management and Govt. authority comes to a specific conclusion about our restart of the business…We all shall stand united and be positive meanwhile as things are expected to happen soon

10.05.2012 വളരെ പ്രധാനപ്പെട്ട ഒരു ദിവസമായിരുന്നു. നമ്മുടെ വാദം ബഹു.സുപ്രീം കോടതി കേള്‍ക്കുകയും, എല്ലാ പാനലിസ്റ്റുകളുടെ താല്പ്പര്യങ്ങള്‍ക്കനുസരിച്ച് ഒരു അനുകൂലമായ പ്രതികരണം ലഭിക്കുകയുമുണ്ടായി. വളരെ സന്തോഷത്തോടെ ആ വിവരങ്ങള്‍ നിങ്ങളുമായി പങ്കുവെക്കുവാന്‍ ആഗ്രഹിക്കുന്നു. എല്ലാ പാര്‍ടികളുടെയും വാദങ്ങള്‍ ബഹു.സുപ്രീം കോടതി കേള്‍ക്കുയുണ്ടായി. കമ്പനിയുടെ ഡാറ്റ തിരികെ നല്‍കുന്നതിനെതിരെ E.O.W അടിസ്ഥാനരഹിതമായ എതിര്‍പ്പുകള്‍ ഉന്നയിക്കുകയാണെന്നും കാര്യങ്ങള്‍ പരിഹരിക്കുന്നതിനു ഒരു തരത്തിലും E.O.W സഹകരിക്കുന്നില്ലെന്നും സുപ്രീം കോടതിയില്‍ കെട്ടിവെച്ചിട്ടുള്ള പണം പാനലിസ്റ്റുകള്‍ക്ക് കൊടുക്കാന്‍ കഴിയുന്നില്ലെന്നുമുള്ള നമ്മുടെ വാദം ബഹു. സുപ്രീം കോടതി കേള്‍ക്കുകയുണ്ടായി. ഈ വാദത്തിന്റെ അടിസ്ഥാനത്തില്‍ അന്തിമ തീര്‍പ്പ് കല്പ്പിക്കുന്നതിനു വേണ്ടി കോടതി തീരുമാനിച്ചിട്ടുള്ള ആഗസ്റ്റ് 8 നു തന്നെ കമ്പനിയുടെ ഡാറ്റ കോടതിയില്‍ തിരികെ നല്‍കുന്നതിനുള്ള നിര്‍ദ്ദേശം E.O.W നു കോടതി നല്‍കി. 

വളരെ വലിയ ഒരു നേട്ടമാണ്‌ ഇതിലൂടെ നമുക്ക് ലഭിച്ചിരിക്കുന്നത്‌. അതോടൊപ്പം നമ്മള്‍ വിജയത്തിലേക്ക് ഇഞ്ചോടിഞ്ച് അടുത്തുകൊണ്ടിരിക്കുകയാണ്‌. സാധാരണഗതിയില്‍ വര്‍ഷങ്ങള്‍കൊണ്ട് ലഭിക്കേണ്ട കാര്യങ്ങള്‍ നമുക്ക് 3-4 മാസങ്ങള്‍ കൊണ്ട് നേടാന്‍ സാധിക്കും. നമ്മുടെ പ്രശ്നങ്ങളെല്ലാം പരിഹരിക്കുന്നതിനു വേണ്ടിയുള്ള എല്ലാ നടപടികളും ഏകീകരിക്കുന്നതിനു ഈ ഒരു ഇടക്കാലം നമ്മളെ സഹായിക്കും. 

മറ്റൊരു കാര്യം ചൂണ്ടിക്കാണിക്കാന്‍ ആഗ്രഹിക്കുന്നത്, നവനീത് കോശ്ലക്ക്‌ ലഭിക്കുവാനുള്ള പണം AISPA അംഗങ്ങള്‍ നല്‍കിയതിലൂടെ തനിക്ക് ഈ കേസുമായി മുന്നോട്ട് പോകുവാന്‍ താല്പര്യമില്ലെന്ന് അറിയിച്ചുകൊണ്ട് അദ്ദേഹം തന്നെ ബഹു.മുംബൈ ഹൈ കോടതിയില്‍ അഫിഡവിറ്റ് നല്‍കിയിട്ടും ഇപ്പോഴും ഒന്നല്ലെങ്കില്‍ മറ്റൊരു തരത്തില്‍ അദ്ദേഹം വീണ്ടും വീണ്ടും ഇടപെട്ടുകൊണ്ടിരിക്കുകയാണ്‌. എക്സിറ്റ് ആപ്ലിക്കേഷന്‍ നല്‍കിയ പാനലിസ്റ്റുകളുടെ പണം തിരികെ നല്‍കുവാന്‍ വേണ്ടി കമ്പനി നടത്തുന്ന ഈ പ്രക്രിയകള്‍ക്കിടയില്‍ കാര്യങ്ങള്‍ വഴിതെറ്റിക്കാന്‍ വേണ്ടി അദ്ദേഹം നടത്തുന്ന ഇത്തരം ഗൂഡോദ്ദേശ്യം എന്താണെന്ന് നമുക്ക് മനസ്സിലാകുന്നില്ല.

I hope everyone is doing well in battling the daily life in our day…As i am going busy for these few days i am not able to attend any calls…Though i make it clear this is the safest platform for communication here itself and i am sure everyone is reliable and trustworthy here…
