investigation agency EOW is now willing to file the Chargesheet

Good Evening To All !!!
I wish to inform all that finally the so called investigation agency EOW is now willing to file the Chargesheet which was the most awaited news which everyone was waiting for a long time…
Now after filing the chargesheet eow might not be able to investigate further into the matter as said by the investigation officer that “now they have enough evidence to file the chargesheet against the company”
The chargesheet is expected to be filed soon in couple of weeks time now which is expected and not confirmed yet as we never know the intention of the investigation agency which is very much uncertain and unexpected…
So as per my analysis the chargesheet can be clubbed in AP CB-CID which can run in trial and shall not create any hurdle in proceedings of the company for smooth business operation or payments to the earliest…
The RBI writ which the company filed in high court as said by the sources has a positive outcome through which the company has initiated the processing of Exit Option to all Exit Optioners… and through this step the company get rid of other criminal charges which were imposed by the govt. authorities
Regarding the arrest of one of the company’s official EX-COO (Pankaj Shah) who resigned from the company long back and got terminated from the company whatsoever was the reason behind it the official who was no longer working as company’s rep when the business was operational…and instead of Pankaj Shah …Tarak Bajpai was replaced as the COO of the company who carried the business operation further and organized many events and meetings to promote the business in vast…
Once the Exit option payments starts crediting in the bank account of the panelists and Thane and Raigad case which can either get disposed or move to trial both the ways shall be the best for the company…So friends stay tuned and be positive as now only positive things are expected and the Victory shall all be OURS…But still some people from the management really needs to be changed for the welfare of the company towards its panelists for a long run

This wonderful family of Speakasians received a rude jolt when we realized that the hearing in WP/383/2011 scheduled to be heard today (8th August, 2012) will not take place, more so as the matter was supposed to have been listed for “Final Disposal”
I could sense the agony and disillusionment amongst my brethren; I would like to remind this magical family that through the various updates on AISPA we have many a time explained that every date in any matter has to be approached with full trust and with implicit faith in the judiciary but with NO EXPECTATIONS, precisely for such an eventuality.
I agree that such things are not a matter of every day happening and are surely not normal, but then again this is surely not abnormal.
No particular Authority and surely not the judiciary is to be blamed for this delay. Remember in the final analysis it is the Judiciary which will give us justice and we can surely not have disillusionment with the judicial system or the Judiciary itself.
The order in WP/1523/2012 which is the Company Writ against the RBI was uploaded on the web site of the Hon’ble Bombay High Court.
There seems to be some clerical mistake whereby instead of 8 weeks that the RBI had asked for to take the decision it shows 8 days, I am sure the Company’s legal team and indeed the office of the Advocate General will move swiftly to get the erroneous order duly rectified.

We all are just on the verge of victory and the movie shall start soon after the consent of the judiciary which is lined up on the way…do not believe in any assumptions as no one can predict what will happen on so or so dates and when it will happen…We all need to follow the practicality which is scheduled on the way and with right decision at the right time which we call Justice…

Friends after revisiting the post of Ashok Sir in the morning I have concluded certain things which I want to share with you. He clearly mentioned that the chances of Main WP 3611/2011 will not be heard in most probabilities . This in my opinion means that the main matter is not listed today was known to the legal team. I think that the efforts to put up the main matter too were underway till the last moment but as per my opinion it did not happen as the Computer system in High Courts being such that no manual changes are allowed .
What is of paramount importance today as per my opinion was that the Divisional Bench straight away disregarded EOW’s claim that the Apex Court has allowed them investigation and ordered the stay to continue till the next hearing This shows the inclination of the Divisional Bench
I am painfully aware of the delay of 15 days but the pointers are in the right direction so please have patience

Reason Behind Contempt Of Court Case By AISPA

Economic offences wing gets court go-ahead to probe SpeakAsia ‘scam’

MUMBAI: The Bombay high court on Wednesday allowed the economic offences wing(EOW) to continue with its probe into the alleged cheating case involving multi-level marketing firm, SpeakAsia. Some of the investors, known as panelists, had filed a petition in the HC saying it was a civil dispute and not a criminal case.

BUT WHAT IS THE FACT ?
“This court has not passed any order in the said criminal application and that they had only recorded the statement of the learned APP”.It is another matter that our dear friend Justice Mr. Mateen Hafeez in an attempt to scandalize the process of the Hon’ble Court through his report appearing on page 4 in Times of India dated 16th June, 2012; had mischievously misquoted the happenings of the Court of 13th June, 2012.

ACTION TAKEN BY AISPA
AISPA has preferred to file a Criminal Application for Suo Motu Contempt of Court against Mateen Hafeez and some more persons, who have assisted him in publishing the mischievous and absolutely false report on page 4 in Times of India dated 16th June, 2012.

A Criminal Application vide Number APPW/322/2012 was filed on 19th June, 2012. This was mentioned before the Hon’ble Court Today, circulation of this has been allowed and the matter is now listed for hearing on Monday the 25th June, 2012

CURRENT STATUS (25th June 2012)
The hearing has taken place in Hon. Mumbai High Court and the court felt it proper that this application be taken up along with the original Writ 3611/2011 and EOW’s Application on 3rd July 2012.

• Stop violating our basic FUNDAMENTAL RIGHT TO LIVELIHOOD.

• Authorities should help in getting the money refunded to consumers that is the real        PUBLIC INTEREST.

• EOW should STOP HARASSING CONSUMERS. We are honest Indian Citizens our fight is for protecting the rights of our Panelists and Consumers.

• Allow the company (SAOL) to restart business in India and help in providing EMPLOYMENT TO A LARGE POPULATION of computer educated middle class and lower middle class youth.

• Immediately set up a regulatory mechanism to monitor and regulate DIRECT SALES INDUSTRY.

• REWORK THE PCMC (banning) Act, 1978. Direct Sales Professionals are consenting adults and should be kept out of the purview of 2(c) of the Act.

• REGULATE THE MEDIA and control it from spreading false or malicious campaign. Media is indulging in CONTEMPT of COURT of the highest degree by prejudicing the system and the Judiciary.
